These terms govern your use of Kloudboy's hosting services. Please read them carefully before using our platform.

1. Acceptance of Terms

By accessing or using Kloudboy's hosting services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

These terms apply to all users of our services, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Service Description

Kloudboy provides cloud hosting services including but not limited to:

  • WordPress optimized hosting
  • Laravel application hosting
  • Node.js application hosting
  • Domain registration and management
  • SSL certificate provisioning
  • Database hosting and management
  • Email hosting services
  • Technical support and maintenance

3. Account Registration and Security

Account Creation

To use our services, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials.

Account Security

  • You must use strong passwords and enable two-factor authentication when available
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend accounts that show signs of compromise

Account Eligibility

You must be at least 18 years old to create an account. If you are under 18, you may only use our services with parental consent and supervision.

4. Acceptable Use Policy

Permitted Uses

You may use our services for lawful purposes only, including:

  • Hosting legitimate websites and applications
  • Storing and processing lawful content
  • Running authorized business operations
  • Educational and personal projects

Prohibited Activities

You may not use our services for:

  • Illegal activities or content that violates applicable laws
  • Spamming, phishing, or other malicious communications
  • Hosting malware, viruses, or other harmful software
  • Copyright infringement or intellectual property violations
  • Adult content or services (without prior approval)
  • Cryptocurrency mining or similar resource-intensive activities
  • Activities that compromise server security or stability
  • Reselling services without authorization

5. Service Level Agreement (SLA)

Uptime Guarantee

We guarantee 99.9% uptime for our hosting services, calculated monthly. If we fail to meet this guarantee, you may be eligible for service credits as follows:

  • 99.0% - 99.8% uptime: 10% service credit
  • 95.0% - 98.9% uptime: 25% service credit
  • Below 95.0% uptime: 50% service credit

Exclusions

The uptime guarantee does not apply to downtime caused by:

  • Scheduled maintenance (with 24-hour notice)
  • Emergency maintenance for security or stability
  • Issues with your website code or configuration
  • Third-party service failures beyond our control
  • DDoS attacks or other malicious activities

6. Payment Terms

Billing and Payments

  • All fees are due in advance and are non-refundable unless otherwise stated
  • Services are billed monthly or annually as selected during signup
  • Prices are subject to change with 30 days' notice
  • Late payments may result in service suspension

Refund Policy

We offer a 30-day money-back guarantee for new customers. Refunds are processed within 5-7 business days and exclude:

  • Domain registration fees
  • SSL certificate costs
  • Setup fees for custom configurations
  • Services used for more than 30 days

7. Data and Content

Your Content

You retain ownership of all content you upload to our services. By using our services, you grant us a limited license to store, process, and deliver your content as necessary to provide our services.

Backups

  • We perform daily automated backups of your data
  • Backups are retained for 30 days
  • You are responsible for maintaining your own backups
  • Backup restoration may incur additional fees

Data Security

We implement industry-standard security measures to protect your data, but you are responsible for:

  • Keeping your applications and plugins updated
  • Using strong passwords and security practices
  • Monitoring your account for suspicious activity

8. Service Modifications and Termination

Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time with reasonable notice.

Account Termination

We may terminate your account for:

  • Violation of these terms
  • Non-payment of fees
  • Illegal or harmful activities
  • Extended periods of inactivity

Data Retention After Termination

Upon termination, your data will be retained for 30 days to allow for account reactivation or data retrieval. After this period, all data will be permanently deleted.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We do not guarantee uninterrupted or error-free service
  • You use our services at your own risk

10. Indemnification

You agree to indemnify and hold harmless Kloudboy, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of our services
  • Your violation of these terms
  • Your violation of any third-party rights
  • Content you upload or transmit through our services

11. Dispute Resolution

Governing Law

These terms are governed by the laws of Kerala, India, without regard to conflict of law principles.

Dispute Resolution Process

  1. Contact our support team to resolve the issue informally
  2. If unresolved, disputes will be subject to binding arbitration
  3. Arbitration will be conducted in Ponnani, Kerala, India
  4. The arbitrator's decision will be final and binding

12. Changes to Terms

We may update these terms from time to time. When we do, we will:

  • Post the updated terms on our website
  • Send email notifications to registered users
  • Provide at least 30 days' notice for material changes

Your continued use of our services after changes take effect constitutes acceptance of the new terms.
